Summary Judgement Obtained in U.S. District Court for the Southern District of West Virginia
Mark McGhee and Tim Mayo obtained summary judgment for two Parkersburg police officers on February 3, 2023. The officers were sued for alleged civil rights violations related to the arrest of the Plaintiff at a sports bar on New Year’s Day. Plaintiff was charged with several crimes but acquitted by a jury. Thereafter, Plaintiff claimed his arrest violated his 4th Amendment rights. The case was pending before the U.S. District Court for the Southern District of West Virginia. Judge Goodwin granted summary judgment based on a legal ruling that Plaintiff did not prove a constitutional violation against one of the officers and that the claims against the other should be dismissed based on qualified immunity.
