Hospital Granted Summary Judgment on Appeal

The West Virginia Supreme Court awarded summary judgment in favor of Summersville Regional Medical Center (SRMC) on November 16, 2018. Kurt Entsminger and Ray Harrell defended SRMC in an employment action in which the plaintiff alleged she was terminated as a result of alleged medical complications from her pregnancy. The Circuit Court of Kanawha County granted summary judgment in favor of SRMC, finding that SRMC did not violate the Pregnant Workers Fairness Act and that Plaintiff failed to plead a claim under the West Virginia Human Rights Act. Plaintiff appealed on the grounds that her complaint sufficiently set forth a claim under the West Virginia Human Rights Act. In its memorandum decision, the Supreme Court upheld summary judgment in favor of SRMC and affirmed the decision of the Circuit Court.
