Summary Judgment Obtained for Physician in Circuit Court of Greenbrier County
Sam Fox and Morgan Villers obtained an award of summary judgment for their client in the Circuit Court of Greenbrier County, West Virginia. The client, a Greenbrier County physician, had been sued for alleged medical negligence involving the interpretation and analysis of a tissue specimen obtained through a needle biopsy. The Court granted summary judgment on the basis that the plaintiff had failed to prove that the physician had proximately caused the alleged injury. As such, the plaintiff’s claims against the physician were dismissed.
