Harrison County Jury Rules in Favor of Diagnostic Radiologist in a Medical Professional Liability Claim
A Harrison County jury recently found against the plaintiffs (husband and wife) in favor of a diagnostic radiologist in a medical professional liability claim. After a six-day trial, the jury found that the radiologist did not deviate from the applicable standard of care in evaluating a diagnostic mammogram and interpreting a breast ultrasound. The plaintiffs had alleged that the radiologist deviated from the standard of care in the diagnostic work-up of a palpable breast mass, which delayed the diagnosis of breast cancer. The jury rejected the plaintiffs’ claim and found that the radiologist acted within the standard of care in his treatment of the patient.
